Trump Administration Insists Removal of Transgender Issues from Sex Education Programs, Several States Agree

No fewer than 11 states and two territories have complied with a recent demand from the federal government to eliminate references of gender identity and the presence of trans and non-binary people from a federal sex education initiative, officials stated.

The administration established a Monday deadline for stripping these mentions, warning the loss of millions in federal funds. Nearly all of the complying states have GOP-led lawmaking bodies and mostly GOP governors.

Legal Challenges and Financial Conflicts

Sixteen other states and Washington DC have filed a lawsuit against the administration's demand, claiming it violates legislative power, which created the $75m sex education program, known as the Personal Responsibility Education Program (Prep).

“HHS fails to show that the new grant conditions are justified, let alone offer any valid reason, other than pretext, for its decisions,” stated the judge, a U.S. district judge in Oregon. “The department offers no proof that it made informed determinations or took into account the statutory objectives.”

Initiative Aims and Federal Review

Prep aims to educate adolescents on positive interactions and how to avoid unplanned parenthood and the transmission of sexually transmitted infections.

In the spring, the Trump administration demanded all jurisdictions obtaining program money to provide a version of their curriculum to HHS and its agency, the ACF office, for a health content assessment.

By late summer, the government dispatched notices to 46 states and territories, informing them that, during the review, it had found “material in the educational programs that fall outside the scope of the program's legal framework.”

Specifically, the administration claimed it had uncovered evidence of “gender ideology,” a phrase often used by conservative factions to refer to the idea that gender is a changeable social construct and that trans and non-binary people exist.

Specific Examples of Required Alterations

The government instructed one state to drop a lesson that stated: “Young people may identify in ways that don’t conform with their assigned gender.”

It instructed another state to delete a line from a educational module that read: “People of all sexual orientations and gender identities need to know how to prevent pregnancy and STDs.”

Moreover, health instructors in numerous states could no longer be told to “demonstrate acceptance and respect for all students, regardless of personal characteristics, including ethnicity, heritage, religion, social class, sexual orientation or gender identity,” according to the letters sent to jurisdictions.

Government Comments and Jurisdictional Reactions

“Oversight is imminent,” declared a federal official, acting assistant secretary of the Administration for Children and Families, in a announcement. “Government money will not be used to poison the minds of the next generation or advance harmful political doctrines.”

Multiple jurisdictions and regions stated they would eliminate the content or had completed the process. These consist of eleven specific states, as well as the U.S. Virgin Islands and the Northern Mariana Islands.

Two other states, Alabama and South Dakota, reported their educational programs never included the language mentioned in the administration’s letters.

Effects on Adolescents and Psychological Well-being

Earlier Incidents and Ongoing Disputes

Earlier this year, the federal government instructed a state to remove references to gender identity from its Prep curriculum.
